1. Website User and Membership Terms and Conditions - General Information

5. TERMINATION AND CANCELLATION

A user may cancel their membership at any time. Cancellation can be done either through the cancellation link found in the footer of the website “Support -> Cancel Membership”. Or by contacting support via the same Support tab, including either account email or username in the cancellation request. After cancellation the user will still have access to the portal, for the remainder of their already paid membership period. To ensure no recurring billing to take place, users should request cancellation a minimum of 24 hours prior expiry. KVS Themes may suspend, disable, or terminate your access to the portal for any reason, including but not limited to if it determines that you have breached this agreement, or engaged in fraud.

6. PAYMENTS AND MEMBERSHIP

Recurring memberships, users MUST cancel their membership 24 hours before it renews each term, to avoid recurring fees. Until cancelled, the user authorizes KVS Themes to continue charging the users payment method to pay membership fees, in accordance with the original subscription. Additional services, are always purchased as one-off services. In the case of individual scene purchases, users will have a lifetime access to all individual scenes purchased regardless of their type of membership. Membership types marked as non-recurring, or purchased via direct debit, or crypto currency will not be re-billed, and no cancellation is needed.

7. FEES

You acknowledge that KVS Themes reserves the right to charge for KVS Themes services and to change its fees from time to time in its discretion. Further more, in the event KVS Themes terminates your rights to use the website because of a breach of this Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.

8. WARRANTIES

You represent and warrant that all of the information provided by you to KVS Themes to participate in the KVS Themes website is accurate and current and you have all necessary right, power, and authority to enter into this Agreement and to perform the acts required of you hereunder.

As a condition to using the KVS Themes, you must agree to the terms of KVS Themes's privacy policy and its modifications. You acknowledge and agree that the technical processing and transmission of the Website, including your User Submissions, may involve transmissions over various networks; and changes to conform and adapt to technical requirements of connecting networks or devices. You further acknowledge and agree that other data collected and maintained by KVS Themes with regard to its users may be disclosed in accordance with the KVS Themes Privacy Policy.

9. INDEMNITY

You agree to defend, indemnify and hold harmless KVS Themes, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

your use of and access to the KVS Themes Website;
your violation of any term of these Terms of Service;
your violation of any third party right, including without limitation any copyright, property, or privacy right; or
any claim that one of your User Submissions caused damage to a third party.

This defense and indemnification obligation will survive these Terms of Service and your use of the KVS Themes Website.

You affirm that you are either more than 18 years of age or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms and Conditions contained herein.

10. ASSIGNMENT

The Terms and Conditions contained herein and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by KVS Themes without restriction.
